On 24 June at 11-12:30 CET, we held a webinar on the newly proposed EU regulation on foreign subsidies distorting the EU internal market. We discussed the key elements of the proposal, its potential impact on foreign operators and practical implications for them. We also discussed how the proposed regulation, and in particular Commission’s investigative powers and notification procedures, will work alongside other EU instruments, such as EU Merger Regulation or FDI obligations. Last but not least, we also addressed the impact of the newly proposed regulation on free trade agreements (FTAs) which include foreign subsidies, including the most recently concluded EU-UK Trade and Cooperation Agreement (TCA).

Our panel, chaired by Anna Drozd, Interim Head of Brussels Office, was:

  • Alexandre Bertuzzi, case handler officer at the European Commission;
  • Alec Burnside, Partner, Dechert LLP
  • Merit Olthoff, Principal Associate, Freshfields Bruckhaus Deringer
  • Siobhan Kahmann, Of Counsel, CMS-CMNO
